PART 1 – INTRODUCTION

  1. About These Terms

1.1 These Website Terms & Conditions of Sale (“Terms”) govern all purchases made through the AbleDay website.

1.2 Please read these Terms carefully before placing an order. By placing an order through the AbleDay website, you confirm that you have read, understood and agree to be bound by these Terms.

1.3 These Terms should be read together with our:

  • Privacy and Cookie Policy
  • Delivery Information
  • Returns & Refunds Policy
  • VAT Relief Information (where applicable)

1.4 Nothing within these Terms affects your statutory rights as a consumer.

  1. Definitions

In these Terms, unless the context otherwise requires:

AbleDay means AbleDay Mobility Group Limited, the operator of the AbleDay website.

AbleDay Website means the online platform operated by AbleDay through which customers may browse and place orders.

Authorised Partner means an independent business that has entered into an agreement with AbleDay to operate as an authorised AbleDay Partner.

Business Day means Monday to Friday excluding public holidays in England and Wales.

Customer, you or your means the individual purchasing products through the AbleDay Website.

Contract means the legally binding agreement for the supply of goods formed in accordance with these Terms.

Order means your request to purchase products through the AbleDay Website.

Partner Delivery means the delivery service carried out by the Supplying Partner, including assembly, demonstration and product handover where applicable.

Products means the mobility equipment and related goods offered for sale through the AbleDay Website.

Supplying Partner means the Authorised Partner allocated by AbleDay to fulfil your Order.

Website means www.ableday.co.uk together with any associated webpages operated by AbleDay.


PART 2 – ABOUT ABLEDAY

  1. The AbleDay Network

3.1 AbleDay operates a nationwide network of independent mobility specialists trading as Authorised AbleDay Partners.

3.2 The AbleDay Website enables customers to browse products, place orders and access mobility products and services supplied through the AbleDay Partner network.

3.3 Each Authorised Partner is an independent business responsible for supplying products allocated to it, providing delivery services where applicable and delivering after-sales support in accordance with AbleDay’s network standards.

3.4 All Authorised Partners are required to meet minimum standards relating to customer service, technical competence, product knowledge and ongoing support.

  1. AbleDay’s Role

4.1 AbleDay operates the Website and provides the technology platform through which Orders are placed.

4.2 AbleDay is responsible for:

  1. a) operating and maintaining the Website;
  2. b) advertising and promoting products available through the AbleDay network;
  3. c) receiving and processing Orders placed through the Website;
  4. d) allocating Orders to an appropriate Supplying Partner;
  5. e) collecting payment in respect of Orders placed through the Website; and
  6. f) providing administrative support in connection with Orders where appropriate.

4.3 Once an Order has been allocated, the Supplying Partner is responsible for fulfilling the Order, including (where applicable):

  1. a) supplying the Products;
  2. b) arranging Partner Delivery;
  3. c) providing demonstrations;
  4. d) providing warranty support;
  5. e) providing after-sales service.

4.4 Following allocation of an Order, the Supplying Partner shall normally be the Customer’s primary point of contact regarding delivery arrangements, product support, warranty matters and after-sales enquiries.

4.5 AbleDay operates the Website and manages the online ordering process for products supplied through its authorised partner network. The Supplying Partner identified on your invoice is responsible for supplying the Products, providing delivery services (where applicable) and delivering warranty and after-sales support in accordance with these Terms.


PART 3 – PLACING AN ORDER

  1. Placing an Order

5.1 Orders may only be placed by individuals aged 18 years or over.

5.2 By placing an Order you confirm that:

  1. a) all information provided is accurate;
  2. b) you are authorised to use the chosen payment method;
  3. c) you intend to enter into a legally binding agreement in accordance with these Terms.

5.3 The submission of an Order constitutes an offer to purchase the selected Products. Submission of an Order does not constitute acceptance of that offer.

  1. Allocation of Orders

6.1 Following receipt of an Order, AbleDay will allocate the Order to an appropriate Authorised Partner.

6.2 Allocation is determined using criteria which may include:

  1. a) delivery postcode;
  2. b) partner territory;
  3. c) product availability;
  4. d) operational capacity;
  5. e) other operational factors reasonably considered necessary to ensure efficient and timely fulfilment.

6.3 Customers cannot request allocation to a specific Authorised Partner unless expressly offered by AbleDay.

  1. Formation of the Contract

7.1 Shortly after submitting an Order, you will receive an automated acknowledgement confirming that your Order has been received.

7.2 This acknowledgement confirms receipt of your Order only and does not constitute acceptance of your offer.

7.3 Your Order will be reviewed before acceptance.

7.4 Subject to these Terms, a Contract is formed only when:

  1. a) your Order has been accepted;
  2. b) payment has been successfully authorised; and
  3. c) an Order Confirmation identifying the Supplying Partner has been issued.

7.5 If your Order cannot be accepted for any reason, you will be notified as soon as reasonably practicable and any payment already taken will be refunded.

  1. Reasons an Order May Not Be Accepted

AbleDay reserves the right not to accept an Order where:

  1. a) the Product is unavailable;
  2. b) pricing or product information contains an obvious error;
  3. c) payment cannot be authorised;
  4. d) there is reason to believe fraudulent activity has occurred;
  5. e) delivery cannot reasonably be completed;
  6. f) circumstances arise outside our reasonable control.
  7. Changes to Orders

9.1 If you wish to amend or cancel an Order before it has been accepted, you should do so as soon as possible.

9.2 Once an Order has been accepted, any amendment or cancellation will be subject to these Terms and any applicable statutory cancellation rights.

  1. Customer Communications

10.1 AbleDay and the Supplying Partner may communicate with you regarding your Order using the contact details you provide.

10.2 Such communications may include:

  • Order confirmation;
  • Delivery updates;
  • Requests for additional information;
  • Warranty information;
  • Product support;
  • Product recall notices;
  • After-sales communications relating to your purchase.

10.3 It is your responsibility to ensure your contact details remain accurate throughout the Order process.


PART 4 – PRODUCTS, PRICING & PAYMENT

11. Product Information

11.1 AbleDay aims to ensure that all product descriptions, specifications, dimensions, weights, colours and images displayed on the Website are accurate at the time of publication.

11.2 Product images are provided for illustrative purposes only. Whilst every effort is made to accurately represent products, actual colours, finishes and appearances may vary slightly due to manufacturing variations or individual screen settings.

11.3 Certain products may be updated, improved or modified by the manufacturer without prior notice, provided that such changes do not materially reduce the product’s functionality or performance.

11.4 Product availability is subject to stock levels and may change without notice.

11.5 Where a product becomes unavailable after an Order has been placed, the Customer will be informed as soon as reasonably practicable. The Customer may choose to:

  1. a) wait for new stock;
  2. b) select an alternative product (subject to any price adjustment); or
  3. c) cancel the Order and receive a full refund.
  4. d) agree to a revised delivery estimate.

12. Prices

12.1 All prices displayed on the Website are shown in Pounds Sterling (£).

12.2 Prices will indicate whether VAT is included or whether VAT relief may be available.

12.3 Prices may be changed at any time prior to an Order being accepted.

12.4 Once an Order has been accepted, the agreed purchase price shall not be altered except:

  1. a) where requested by the Customer;
  2. b) where additional services are subsequently requested; or
  3. c) where required by law.

13. Pricing Errors

13.1 Whilst every reasonable effort is made to ensure pricing accuracy, errors may occasionally occur.

13.2 If an obvious pricing error is identified before an Order is accepted, AbleDay reserves the right to cancel the Order and refund any payment already received.

13.3 Where reasonably possible, the Customer may instead be offered the opportunity to proceed at the correct price.

14. VAT Relief

14.1 Certain products may qualify for zero-rating for VAT under UK legislation.

14.2 It is the Customer’s responsibility to ensure that they satisfy the eligibility requirements before claiming VAT relief.

14.3 Where VAT relief is claimed, the Customer must complete the required declaration before the Order can be processed.

14.4 If the Customer is found not to qualify for VAT relief, the Customer shall remain responsible for payment of any VAT properly due.

14.5 AbleDay and the Supplying Partner reserve the right to refuse a claim for VAT relief where sufficient information has not been provided.

15. Payment

15.1 Payment must be made in full before Products are dispatched unless otherwise expressly agreed.

15.2 Payment may be made using the payment methods displayed during checkout.

15.3 Payment processing is carried out through secure third-party payment providers.

15.4 AbleDay manages payment processing through the Website as part of the online ordering process operated for the AbleDay partner network.

15.5 A payment confirmation will be issued following successful payment.

15.6 Payment processing does not affect the Customer’s statutory rights.

16. Invoicing

16.1 Following acceptance of an Order, the Customer will receive an invoice identifying the Supplying Partner responsible for fulfilling the Order.

16.2 The invoice will include:

  1. a) the Supplying Partner’s business name;
  2. b) the Supplying Partner’s registered address or trading address, where applicable;
  3. c) details of the Products ordered;
  4. d) delivery charges (if applicable);
  5. e) VAT information (where applicable); and
  6. f) the Supplying Partner’s contact details for delivery, warranty and after-sales enquiries.

16.3 Customers should retain their invoice as proof of purchase.

16.4 The invoice should be referred to when contacting the Supplying Partner regarding delivery, product support, warranty services or returns.

16.5 The invoice identifies the Supplying Partner responsible for the fulfilment of the Order and should be retained for warranty, servicing, returns and future support.

17. Payment Security

17.1 AbleDay does not store complete payment card details.

17.2 Payments are processed using secure encrypted payment systems provided by authorised payment service providers.

17.3 Whilst AbleDay takes reasonable steps to protect payment information, Customers are responsible for ensuring that their own devices and internet connections are secure when placing Orders.

18. Promotions and Discounts

18.1 Promotional offers may be available from time to time.

18.2 Unless expressly stated otherwise:

  1. a) only one promotional offer may be used per Order;
  2. b) promotional offers cannot be exchanged for cash;
  3. c) promotional offers cannot be applied retrospectively after an Order has been placed.

18.3 AbleDay reserves the right to withdraw or amend promotional offers at any time prior to an Order being accepted.

19. Gift Vouchers (if offered)

19.1 Gift vouchers may only be redeemed against eligible purchases made through the Website.

19.2 Gift vouchers are non-refundable and cannot be exchanged for cash.

19.3 Lost, stolen or expired gift vouchers may not be replaced.

20. Fraud Prevention

20.1 AbleDay reserves the right to carry out reasonable verification checks where fraud is suspected.

20.2 Orders may be delayed or cancelled where:

  1. a) payment details cannot be verified;
  2. b) fraudulent activity is reasonably suspected;
  3. c) identity verification cannot be completed.

20.3 AbleDay may request additional information before accepting an Order where necessary to protect Customers and the integrity of the Website.


PART 5 – DELIVERY, RISK & OWNERSHIP

21. Delivery Services

21.1 Delivery options available for each Product are displayed during the checkout process.

21.2 Depending on the Product purchased, delivery may be provided by:

  1. a) Direct Delivery; or
  2. b) Partner Delivery.

21.3 The delivery option available for each Product is determined by the nature of the Product and product characteristics and operational requirements.

22. Direct Delivery

22.1 Selected Products may be delivered directly to the delivery address provided by the Customer.

22.2 Direct Delivery is generally available for Products which can safely be transported without specialist installation or demonstration.

22.3 Estimated delivery for Direct Delivery is 2–3 Business Days from acceptance of the Order unless otherwise stated.

22.4 Products delivered by Direct Delivery are normally supplied boxed and may require simple assembly by the Customer.

22.5 User manuals and manufacturer documentation will be supplied where applicable.

23. Partner Delivery

23.1 All powered mobility scooters and powered wheelchairs are supplied using Partner Delivery unless otherwise stated.

23.2 Selected manual wheelchairs, rollators and other Products may also be eligible for Partner Delivery where this option is selected during checkout.

23.3 Estimated delivery for Partner Delivery is 3–5 Business Days from acceptance of the Order unless otherwise stated.

23.4 Partner Delivery may include, where appropriate:

  1. a) delivery to the Customer’s address;
  2. b) assembly of the Product;
  3. c) inspection prior to handover;
  4. d) demonstration of the Product’s principal functions;
  5. e) basic operating guidance;
  6. f) confirmation that the Product is operating correctly at the time of delivery.

23.5 The exact services provided may vary depending upon the Product purchased.

24. Delivery Appointments

24.1 Where Partner Delivery is selected, the Supplying Partner will normally contact the Customer to arrange a mutually convenient delivery appointment. Reasonable efforts will be made to accommodate preferred delivery dates, although specific delivery dates cannot be guaranteed.

24.2 The Customer shall ensure that a responsible adult aged 18 years or over is present to accept delivery where required.

24.3 If the Customer requests a change to an agreed delivery appointment, reasonable efforts will be made to accommodate the request.

25. Delivery Access

25.1 It is the Customer’s responsibility to ensure that reasonable access is available for delivery.

25.2 Customers should advise the Supplying Partner before delivery if there are:

  1. a) stairs;
  2. b) restricted parking;
  3. c) gated access;
  4. d) narrow doorways;
  5. e) other access limitations that may reasonably affect delivery.
  6. f) steep driveways or difficult external access.

25.3 Additional delivery charges may apply where exceptional access requirements were not disclosed before delivery.

26. Delivery Estimates

26.1 All delivery times are estimates only.

26.2 Whilst AbleDay and the Supplying Partner will use reasonable endeavours to meet estimated delivery dates, they are not guaranteed.

26.3 Delays may occur due to:

  1. a) manufacturer availability;
  2. b) courier delays;
  3. c) adverse weather;
  4. d) transport disruption;
  5. e) circumstances outside reasonable control.

26.4 Neither AbleDay nor the Supplying Partner shall be liable for reasonable delivery delays arising from such circumstances.

27. Failed Deliveries

27.1 If delivery cannot be completed because:

  1. a) nobody is available to receive the Product;
  2. b) access has not been provided;
  3. c) incorrect delivery information has been supplied;

reasonable additional delivery or collection charges may apply.

27.2 If repeated delivery attempts are unsuccessful, the Order may be cancelled and any refund made subject to reasonable deductions permitted by law.

28. Inspection Upon Delivery

28.1 The Customer should inspect the Product as soon as reasonably practicable after delivery.

28.2 If the Product appears damaged, incomplete or incorrect, the Customer should notify the Supplying Partner as soon as reasonably practicable.

28.3 Customers should retain all packaging until they are satisfied that the correct Product has been supplied and is free from transit damage.

28.4 Minor cosmetic imperfections which do not affect the safety, function or intended use of the Product shall not necessarily constitute a fault.

29. Passing of Risk

29.1 Risk in the Products passes to the Customer when the Products are delivered to the Customer or to a person identified by the Customer to take possession of the Products.

29.2 If delivery is delayed due to the Customer’s instructions or failure to accept delivery, risk shall pass when delivery would otherwise have taken place.

30. Ownership of Products (Retention of Title)

30.1 Ownership of the Products shall not pass to the Customer until payment has been received in full.

30.2 Until ownership passes, the Customer shall not:

  1. a) sell;
  2. b) hire;
  3. c) pledge;
  4. d) otherwise dispose of the Products except where permitted by law.

31. Collection of Products

31.1 Where collection from the Supplying Partner is offered, the Customer will be notified when the Product is available.

31.2 The Customer may be required to provide proof of identity or proof of purchase when collecting Products.

31.3 Collection availability may vary between Supplying Partners and Products.

32. Delays Beyond Reasonable Control

32.1 Neither AbleDay nor the Supplying Partner shall be responsible for delays caused by events beyond their reasonable control.

32.2 Such events may include:

  1. a) severe weather;
  2. b) industrial action;
  3. c) transport disruption;
  4. d) supplier failure;
  5. e) government restrictions;
  6. f) acts of God;
  7. g) other unforeseen events outside reasonable control.

32.3 Where such circumstances arise, reasonable efforts will be made to keep the Customer informed and to complete delivery as soon as reasonably practicable.


PART 6 – CANCELLATIONS, RETURNS & REFUNDS

33. Your Right to Cancel

33.1 If you are purchasing as a consumer online, you generally have the legal right to cancel your Order within 14 days of receiving the Products without giving any reason.

33.2 To exercise your right to cancel, you should notify your Supplying Partner before the expiry of the cancellation period.

33.3 The contact details of your Supplying Partner are shown on your invoice and can also be found using the Find Your Local Partner section of the AbleDay Website.

33.4 Once cancellation has been requested, the Supplying Partner will provide instructions regarding the return or collection of the Products.

34. Returning Products Following Cancellation

34.1 Unless otherwise agreed, Products should be returned within 14 days of notifying the Supplying Partner that you wish to cancel your Order.

34.2 Products should be returned:

  1. a) unused except to the extent reasonably necessary to inspect them;
  2. b) complete with all accessories;
  3. c) where reasonably practicable, in their original packaging.

34.3 The Customer is responsible for taking reasonable care of the Products whilst they are in their possession.

35. Collection of Large Products

35.1 Certain Products cannot reasonably be returned by post due to their size or weight.

35.2 Where appropriate, the Supplying Partner may arrange collection of such Products.

35.3 Collection charges may apply where permitted by law and where these have been clearly communicated before collection is arranged.

36. Refunds Following Cancellation

36.1 Once returned Products have been received and inspected, refunds will normally be processed within 14 days.

36.2 Refunds will be made using the original payment method wherever reasonably practicable.

36.3 Refunds will normally be processed by AbleDay using the original payment method.

36.4 Where the Customer has chosen a delivery option that is more expensive than the standard delivery service offered for that Product, any additional delivery cost paid for that upgraded service may not be refundable except where required by law.

37. Products Excluded from Cancellation

37.1 Certain Products may not be eligible for cancellation once supplied, including:

  1. a) Products manufactured or customised to the Customer’s specification;
  2. b) sealed hygiene products once unsealed;
  3. c) other Products excluded by applicable consumer legislation.

37.2 This clause does not affect the Customer’s rights in relation to faulty Products.


PART 7 – FAULTY PRODUCTS, WARRANTY & AFTER-SALES SUPPORT

38. Faulty or Damaged Products

38.1 If a Product arrives damaged, incomplete or develops a fault, the Customer should notify the Supplying Partner as soon as reasonably practicable.

38.2 The Supplying Partner will investigate the issue and advise the Customer of the most appropriate resolution. The Customer should not attempt repairs themselves unless instructed to do so by the Supplying Partner or manufacturer.

38.3 Depending upon the circumstances, this may include:

  1. a) replacement parts;
  2. b) repair;
  3. c) replacement Product;
  4. d) refund;
  5. e) another remedy available under applicable consumer law.

39. Consumer Rights

39.1 Nothing within these Terms limits or excludes the Customer’s statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

39.2 Where Products fail to meet the standards required by law, the Customer will be entitled to the remedies available under applicable legislation.

40. Manufacturer’s Warranty

40.1 Many Products are supplied with a manufacturer’s warranty in addition to the Customer’s statutory rights.

40.2 Warranty periods vary between Products and manufacturers.

40.3 Full warranty details are available with the Product documentation or upon request from the Supplying Partner.

40.4 Manufacturer warranties do not affect the Customer’s statutory rights.

41. Warranty Support

41.1 Warranty inspections, repairs and support will normally be arranged through the Supplying Partner.

41.2 The Supplying Partner may request photographs, videos or other information to assist in diagnosing a reported fault before arranging an inspection or repair.

41.3 The Supplying Partner may:

  1. a) carry out repairs;
  2. b) arrange replacement parts;
  3. c) liaise with manufacturers where required;
  4. d) arrange further inspection where appropriate.

41.4 Certain warranty claims may require inspection before a repair or replacement can be authorised.

42. Customer Responsibilities

42.1 The Customer should:

  1. a) follow all operating instructions;
  2. b) carry out routine maintenance recommended by the manufacturer;
  3. c) avoid misuse or unauthorised modifications;
  4. d) report faults promptly.

42.2 Failure to follow reasonable operating or maintenance guidance may affect warranty coverage where permitted by law.

43. Repairs Outside Warranty

43.1 Where a Product is no longer covered by warranty, the Supplying Partner may be able to provide repair services.

43.2 Any repair costs will be agreed with the Customer before work commences.

44. Availability of Spare Parts

44.1 Spare parts are generally available for many Products.

44.2 Availability depends upon the manufacturer and the age of the Product.

44.3 Neither AbleDay nor the Supplying Partner guarantees that spare parts will remain available indefinitely after a Product has been discontinued.

45. Mobility Product Demonstrations

45.1 Where Partner Delivery includes a demonstration, the Customer should take the opportunity to familiarise themselves with the Product.

45.2 The Customer is encouraged to ask any questions regarding:

  1. a) operation;
  2. b) charging;
  3. c) folding or dismantling;
  4. d) maintenance;
  5. e) safety features.

45.3 The Customer should advise the Supplying Partner immediately if anything appears incorrect before the delivery is completed.

46. Ongoing After-Sales Support

46.1 The Supplying Partner will normally remain the Customer’s primary point of contact for:

  1. a) servicing;
  2. b) repairs;
  3. c) warranty enquiries;
  4. d) replacement parts;
  5. e) general after-sales support.

46.2 Contact details for the Supplying Partner are provided on the Customer’s invoice and are available through the Find Your Local Partner section of the AbleDay Website.


PART 8 – LIABILITY

47. Consumer Rights

47.1 Nothing contained within these Terms shall limit or exclude any rights which cannot lawfully be limited or excluded under applicable consumer protection legislation.

47.2 These Terms shall be interpreted in accordance with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and all other applicable legislation.

48. Limitation of Liability

48.1 Nothing in these Terms excludes or limits liability for:

  1. a) death or personal injury caused by negligence;
  2. b) fraud or fraudulent misrepresentation;
  3. c) any liability which cannot lawfully be excluded.

48.2 Subject to Clause 48.1, neither AbleDay nor the Supplying Partner shall be liable for:

  1. a) losses not reasonably foreseeable;
  2. b) indirect or consequential losses suffered by a Customer purchasing as a consumer, except where such exclusion is prohibited by law.

48.3 Nothing within this clause affects the Customer’s statutory rights.

49. Customer Use of Products

49.1 The Customer is responsible for using Products safely and in accordance with:

  1. a) the manufacturer’s instructions;
  2. b) any demonstration provided;
  3. c) any safety guidance supplied with the Product.

49.2 Customers should ensure that Products are suitable for their intended use and that any stated user weight limits, operating environments and maintenance requirements are followed.

49.3 Failure to follow reasonable operating instructions may affect warranty entitlement where permitted by law.

50. Force Majeure

50.1 Neither AbleDay nor the Supplying Partner shall be liable for any delay or failure to perform obligations where caused by circumstances beyond reasonable control.

50.2 Such circumstances include, but are not limited to:

  1. a) severe weather;
  2. b) flooding;
  3. c) fire;
  4. d) pandemic or epidemic;
  5. e) industrial action;
  6. f) supplier disruption;
  7. g) transport failure;
  8. h) government action;
  9. i) acts of terrorism;
  10. j) any other event beyond reasonable control.

50.3 Where such circumstances occur, reasonable efforts will be made to minimise disruption and to keep Customers informed.


PART 9 – COMPLAINTS

51. Customer Service

51.1 AbleDay aims to provide a high standard of customer service throughout its partner network.

51.2 If you have a question regarding:

  1. a) delivery;
  2. b) installation;
  3. c) demonstrations;
  4. d) servicing;
  5. e) warranty;
  6. f) repairs;

you should contact your Supplying Partner in the first instance.

51.3 Contact details for your Supplying Partner are provided on your invoice and are available using the Find Your Local Partner section of the Website.

52. Complaints Procedure

52.1 If you are dissatisfied with any aspect of the Products or services supplied by your Supplying Partner, you should first raise the matter directly with that Supplying Partner.

52.2 The Supplying Partner will investigate your complaint and aim to resolve it promptly.

52.3 If the matter cannot be resolved, or you believe that AbleDay’s involvement is required, you may ask the Supplying Partner to refer the matter to AbleDay or contact AbleDay using the contact details published on the Website.

52.4 AbleDay may assist in facilitating communication between the Customer and the Supplying Partner where appropriate but does not replace the Supplying Partner’s responsibility for handling matters relating to the supply of Products, warranty or after-sales service.

52.5 Where a complaint cannot be resolved directly with the Supplying Partner, AbleDay may review the matter to ensure compliance with the standards required of its authorised partner network.

53. Product Safety

53.1 If you believe that a Product presents a safety concern, you should immediately stop using the Product where it is safe to do so.

53.2 You should contact your Supplying Partner without delay so that appropriate advice can be provided.

53.3 Where appropriate, AbleDay and the Supplying Partner may work together with the manufacturer to investigate reported safety concerns.


PART 10 – PRIVACY

54. Personal Information

54.1 AbleDay processes personal information in accordance with its Privacy Policy.

54.2 Personal information may be shared with the Supplying Partner where reasonably necessary to:

  1. a) fulfil your Order;
  2. b) arrange delivery;
  3. c) provide warranty support;
  4. d) provide after-sales services;
  5. e) verify eligibility for VAT relief;
  6. f) comply with legal obligations.

54.3 By placing an Order, you acknowledge that your personal information will be shared with the allocated Supplying Partner for these purposes.

55. Marketing

55.1 AbleDay and the Supplying Partner will only send marketing communications where permitted by law or where you have provided the necessary consent.

55.2 You may withdraw your marketing consent at any time.


PART 11 – INTELLECTUAL PROPERTY

56. Ownership

56.1 All content published on the Website, including text, graphics, logos, photographs, videos, software and branding, is owned by or licensed to AbleDay unless otherwise stated.

56.2 No part of the Website may be copied, reproduced or commercially exploited without AbleDay’s prior written permission.

57. Trade Marks

57.1 “AbleDay”, the AbleDay logo and associated branding are trade marks or trading styles used by AbleDay.

57.2 Nothing within these Terms grants permission to use AbleDay’s branding without prior written consent.


PART 12 – GENERAL

58. Changes to these Terms

58.1 AbleDay may update these Terms from time to time.

58.2 Any changes shall apply only to Orders placed after the revised Terms have been published.

59. Invalid Provisions

59.1 If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.

60. No Waiver

60.1 Failure by AbleDay or the Supplying Partner to enforce any provision of these Terms shall not constitute a waiver of any rights.

61. Entire Agreement

61.1 These Terms, together with the documents referred to within them, constitute the entire agreement relating to purchases made through the Website.

61.2 Nothing in this clause limits any statutory rights available to consumers.

62. Electronic Communications

62.1 Customers agree that AbleDay and the Supplying Partner may communicate electronically regarding Orders, deliveries, warranty matters, recalls and other matters relating to the Contract.

63. Governing Law

63.1 These Terms shall be governed by the laws of England and Wales.

63.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable law provides otherwise for consumers residing in another part of the United Kingdom.


SCHEDULE 1 – VAT RELIEF

  1. VAT Relief

Certain mobility products supplied through the AbleDay Website may qualify for VAT relief under UK legislation.

VAT relief is only available where the Customer satisfies the eligibility requirements laid down by HM Revenue & Customs.

The availability of VAT relief will be clearly indicated on eligible Products.

  1. Eligibility

Customers may generally qualify where they are:

  • chronically sick; or
  • disabled,

as defined by HM Revenue & Customs.

Temporary injuries do not normally qualify.

  1. Declaration

Where VAT relief is claimed, Customers must complete the required declaration before their Order can be processed.

Providing false information may result in VAT becoming payable.

  1. Evidence

AbleDay or the Supplying Partner may request additional information where reasonably necessary to verify a VAT relief claim.


SCHEDULE 2 – ORDER FULFILMENT & DELIVERY SERVICES

Direct Delivery

Selected Products are available using Direct Delivery.

These Products are:

  • securely packaged;
  • delivered directly to the delivery address;
  • normally delivered within 2–3 Business Days;
  • supplied boxed;
  • accompanied by manufacturer documentation where applicable.

Partner Delivery

Powered mobility scooters and powered wheelchairs are supplied using Partner Delivery.

Certain manual wheelchairs, rollators and other Products may also be eligible where selected during checkout.

Partner Delivery normally includes:

  • delivery to your address;
  • assembly (where applicable);
  • inspection;
  • operational checks;
  • demonstration;
  • safe handover of the Product to the Customer;
  • basic operating guidance.

Delivery Areas

Orders are allocated to an Authorised AbleDay Partner based on operational criteria, including delivery postcode and partner territory.

Customers are unable to select their preferred Supplying Partner unless specifically offered by AbleDay.

Delivery Times

Delivery estimates are provided for guidance only.

Unexpected delays may occur due to supplier availability, courier delays or circumstances outside reasonable control.


SCHEDULE 3 – RETURNS PROCEDURE

Cancelling an Order

Notify your Supplying Partner within the statutory cancellation period.

Their details appear on your invoice.

Returning Smaller Products

Smaller Products should normally be securely packaged and returned in accordance with the instructions provided by the Supplying Partner.

Returning Larger Products

Where Products cannot reasonably be returned by post, the Supplying Partner will advise whether collection can be arranged.

Collection charges may apply where permitted by law.

Refund Process

Refunds are normally processed after:

  • returned Products have been received;
  • the Products have been inspected;
  • the return has been approved.

Refunds are made using the original payment method wherever reasonably practicable.


SCHEDULE 4 – WARRANTY PROCEDURE

If you believe your Product has developed a fault:

  1. Contact your Supplying Partner.
  2. Provide your invoice number where possible.
  3. Describe the fault in as much detail as possible.
  4. Record any error codes displayed by the Product, where applicable.
  5. Provide photographs or videos if requested.
  6. The Supplying Partner will advise the next appropriate step.

Depending upon the Product and the nature of the issue, this may include:

  • troubleshooting;
  • replacement parts;
  • inspection;
  • repair;
  • replacement;
  • another appropriate remedy.

SCHEDULE 5 – CUSTOMER RESPONSIBILITIES

Customers should:

  • read the operating instructions supplied with their Product;
  • follow all safety guidance;
  • charge batteries in accordance with the manufacturer’s recommendations;
  • carry out routine maintenance where applicable;
  • retain proof of purchase;
  • inspect Products upon delivery;
  • report faults promptly;
  • use Products only for their intended purpose.

Failure to comply with these recommendations may affect warranty support where permitted by law.


SCHEDULE 6 – NETWORK SUPPORT

AbleDay is committed to ensuring Customers continue to receive appropriate support throughout the lifetime of their Product.

If a Supplying Partner ceases trading, leaves the AbleDay network or is otherwise unable to continue providing after-sales support, AbleDay reserves the right, where reasonably practicable, to appoint another Authorised AbleDay Partner to provide ongoing assistance.

Any replacement partner will normally assume responsibility for:

  • warranty support;
  • servicing;
  • repairs;
  • replacement parts;
  • general after-sales assistance.

This Schedule does not affect any statutory rights available to Customers.
